The quantification of damages plays an essential, but too often overlooked, role in international arbitration. Many thorny issues can arise in the damages phase of an arbitration, and these difficult questions require parties, counsel, and arbitrators to think critically about the procedure, law and calculation of damages. To promote consistency and rigor in the approach to damages within international arbitration, ICCA and ASIL have joined forces together to form a Task Force on Damages in International Arbitration composed of a blue-ribbon panel of leading legal and economics experts from jurisdictions across the globe. As part of this effort, the Task Force is developing an app to help address the needs of practitioners encountering questions on damages – whether for the first or hundredth time.
