Disputes tend to distract resources away from project delivery and exacerbate project delays and costs overruns. The stakes are heightened in the context of the 2032 Games, given the number of projects that will be undertaken at the same time, with immoveable deadlines, limited resources and intense public scrutiny. The Queensland government’s 2032 Delivery Plan includes 14 new and existing venue upgrades across the state. Major South East Queensland and regional transport infrastructure is also set to be upgraded as part of the 2032 Delivery Plan, at the same time as significant investment in hospitals, schools, housing and renewable energy. In this panel discussion, we will hear from distinguished guests including the Honourable Martin Daubney AM KC - mediator, barrister and former judge of the Queensland Supreme Court, and Kiri Parr - director of the Dispute Resolution Board Foundation and Erika Williams - independent arbitrator. Together, we will explore the challenges associated with avoiding and resolving disputes in the in the context of the 2032 Games and the innovations that can (and should) be made in construction litigation, arbitration and alternative dispute resolution methods to address these challenges.

A Different Discourse on Diversity Equal Representation in Arbitration (ERA) is passionate about championing diversity and inclusion in arbitration. The Pledge has and continues to provide essential support to women in arbitration. However, we know diversity goes far beyond gender alone. Today, the call for genuine inclusion is more urgent than ever, as recent global events threaten to undo the progress of past decades. While class actions are well-established in domestic litigation, their role in international arbitration, bothcommercial and investor-state, is still developing. This event will explore the procedural and legal complexities ofmass claims in arbitration, with a focus on recent high-profile cases. These include class action arbitration againsta crypto-currency platform at HKIAC, with hundreds of users seeking compensation for losses during a majortrading outage, Argentina’s experience with mass claims under investment treaties, and the bondholders actionsagainst Switzerland. Through these case studies, the event will examine the evolving mechanisms, challenges,and future of class actions in arbitration.
