At Cleary (Paris, 2015-2017) Ana Gerdau de Borja acted as Counsel to a State in investment arbitration proceedings conducted under ICSID Rules.At Wald (São Paulo, 2010-2015) Ana acted as counsel in 16 commercial arbitration proceedings conducted under ICC, ICDR andBrazilian rules such as CAM/CCBC, CIESP/FIESP and BOVESPA. Proceedings included majorBrazilian infrastructure projects (in the renewable energy, oil & gas and transportation sectors), and mining projects. Ana also helped successfully settle 6 of these proceedings. They included the world’s largest meat processing company, one of the largest French mass retailers, a leading Scandinavian energy investor,Brazilian leading oil & gas players, and a majorBrazilian railway concessionary. During this time Ana participated as a Member of the ICC Task Force proposing revisions leading to new ICC Mediation, Expert and Dispute Board Rules.At BKBG (São Paulo, 2009-2010) Ana acted as counsel in 4 commercial arbitration proceedings underBrazilian arbitration rules in the construction, energy and real estate sectors, and acted as secretary to 3 arbitral tribunals in proceedings under ICC, CIESP/FIESP and the Engineering Institute’s (IE) arbitration rules.Between 2009 and 2010 Ana helped create dispute board rules of a majorBrazilian dispute resolution institution.Ana also worked on a legal opinion as an assistant to ICJ Judge James Crawford in an investment arbitration in 2009 (during her PhD studies at the University of Cambridge).
